Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to crushing hazards: Yard: An employee was operating a CLARK forklift serial number Y6853102342 and the forklift was not provided with a seat belt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install a seat belt retro-fit package and require that a seat belt be worn when the truck is operated.

Among other methods, one feasible and acceptable abatement method to correct the hazard is to train the employees in the facility on the safe way of operating the forktrucks and the company should certify their training.s
