Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: Employees working drilling rig #3 at SEC 15, TWP 14, R 21 in Ogallah, Kansas were exposed to fire and explosion hazards in that the employer did not ensure that no smoking rules were enforced. Among other methods, one feasible and acceptable method to correct this hazard would be to train all employees on the requirement of paragraph 7.1.3 of API RP 54, Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations, 1999 edition. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is completed.
