Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that foot controls of metal working machinery were not guarded to prevent unintentional actuation: In the following instances foot controls were not guarded to prevent unintentional actuation by the operator, or from being struck by material or other objects: a)Wysong Power Shear b)Chicago Dreis & Krump hydraulic press brake One method, among others, to prevent unintentional actuation of a foot control is to place a guard over it.
