Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a) At Meineke Car Care, 120 N. DuPont Highway, New Castle, DE - Employees
used
a Ben Pearson Tubemaster, Model LM 12, Domestic Four Post Auto Lift,
semi-hydraulic
lift, used to elevate cars/trucks. The arm for the mechanical device used
to hold the lift
in the extended position would not engage, thus exposing employees to
injury from being
struck by falling loads. This violation was observed on or about February
18, 2009.
b) At Meineke Car Care, 120 N. DuPont Highway, New Castle, DE - Employees
used
a Ben Pearson, Model-LAS 9, twin  post, frame contact, semi-hydraulic lift
to
elevate
automobiles in bay #3. The pin in the rear arm did not have a collar
around the pin,
causing the arm to sag, exposing employees to injury from being struck by
falling loads.
This violation was observed on or about February 18, 2009.
Among other methods, there are several feasible and acceptable abatement
method to correct
these hazard. One is to provide an mechanical stand, or device to hold the
lift in the fully
extended position. Another feasible and acceptable abatement is to
maintain the lift at this facility
to the manufactures specification.
