Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by / crushing hazards caused by displacement of the load not properly secured: a) Governor Printz Blvd, near Haines Ave, Wilmington, DE. - The employer failed to ensure that the lifting hook attached to a Hydraulic Excavator CAT #345 (Internal identifier #123) was equipped with a functional safety latch. Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard is to replace the missing safety latch on the load hook and follow the requirements of the American National Standard for Overhead Hoists ANSI/ASME B30.16 - 1973 Section 16, paragraph 16-1.1.2.4 Hooks. Abatement certification is required for this violation.
