Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to an impalement hazard from the protruding concrete forming
pins.
a) 1473 S. Du Pont Hwy., Bear, DE. - Observed employees installing
reinforcing
bar within the formwork and walking on the rebar to access the perimeter
formwork to obtain additional rebar for installation. The perimeter
formwork was
held in place by steel forming pins, which were protruding approximately 1
to 2
feet above the formwork. Mushroom style caps were placed on some of the
forming pins, and some forming pins were left unprotected, exposing the
employees to an impalement hazard. Observed this violation on or about
September 24, 2010.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD IS: INSTALL CAPS OVER FORMING PINS OR
INSTALL FORMING PINS TO LEVEL OF FORM OR GRADE.
