Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing injuries by not following the industrial truck manufactures recommendations to wear seat belts and lower stabilizers when placing oversized loads: a) 123 Pumpkin Patch Way, Hockessin, DE - Employee was operating a Sellick truck mounted industrial truck, Model # STM-55, Serial #7989008STM55K, to lift three bundles of 2x4's ranging from 14 to 16 feet long, was not wearing a seat belt and did not lower stabilizers when placing the load. Employee was thrown forward into the overhead guard of the lift truck while depositing materials, sustaining a head injury that required hospitalization. This violation was observed on or about February 1, 2011. Abatement Note: One feasible method to abate this hazard, among other methods, is to require industrial truck operators to wear seat belts and lower stabilizers when placing oversized loads.zed
