Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing injuries by not following manufacturers recommendations to operate mower going only across a slope and not up and down on a slope: a) 1406 Arundel Dr. Wilmington, DE. - 1406 Arundel Dr. Wilmington, DE. - Employee did not follow manufacturer's recommendations on how to operate mower on sloped surfaces. The employee was cutting a sloped surface and did not cut across the slope and instead the employee drove up and then down the slope causing the employee to loose control when going down the slope skidding and overturning in a ditch, sustaining injuries requiring hospitalization. The employee was operating a Kubota mower, Model #ZG327P.
