North Carolina General Duty Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) Facility, Finishing Area - The spray booth was not equipped with a fire suppression system. REF:NFPA 33 - 2000, Chapter 7, Paragraph 1 Spray areas, which include by definition the associated exhaust plenums and exhaust ductwork, and mixing rooms shall be protected with an approved automatic fire protection system. The fire protection system shall be an automatic sprinkler system installed in accordance with Section 7.2 or an alternate fire protection system installed in accordance with Section 7.3. In addition, the fire protection system, regardless of type, shall meet the applicable requirements of 7.1.1 through 7.1.3. NOTE: Among other methods, one feasible acceptable abatement method to correct this hazard is to install an automatic sprinkler system, a dry chemical extinguishing system, a carbon dioxide system, or a gaseous agent extinguishing system per the requirements of section 7.1 of NFPA 33 - 2000.
