Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while standing on the forks of a forklift without fall protection while being elevated: (a) Location - Warehouse: On or about 3/11/08, employees were exposed to a fall hazard of up to 15 feet while elevated on the forks of a forklift to access shelving units. Among other methods, one feasible and acceptable method of abatement would be to: 1) utilize a platform for elevating personnel meeting the requirements in ASME/ANSI B56.1-2000 "Safety Standard for Low Lift and High Lift Trucks for employee use 2) Institute and enforce a company policy prohibiting the elevation of employees with a forktruck without an approved platform.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: (a) Location - Warehouse: On or about 3/11/08, employees were exposed to crushing injuries while operating powered industrial trucks without wearing the seat-belt provided. Among other methods, one feasible and acceptable method of abatement is to train or re- train operators on the hazards and requirements to use seat belts at all times and to enforce seat belt use as required by the manufacturer and most applicable version of ASME/ANSI B56.1.NSI
