Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to dust explosion, deflagration, or other
fire hazards that could have resulted from, or could have been
exacerbated by, the use of nonconductive PVC duct on an indoor
enclosureless dust collector:
a.On or about May 22, 2008, at the establishment, the employer
used a nonconductive duct, such as PVC, to connect a
Pistorious Double Miter Saw, that created combustible wood
dust, to the enclosureless ventilation system.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD INCLUDES FOLLOWING NFPA 664,
STANDARD FOR PREVENTION OF FIRES AND EXPLOSIONS IN WOOD
PROCESSING AND WOODWORKING FACILITIES, 2007 EDITION, INCLUDING
BUT NOT LIMITED TO: ENSURE THAT ALL DUCTWORK IS METALLIC AND
THAT NON CONDUCTIVE DUCTS SUCH AS PVC PIPES ARE NOT USED.
