Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following: a.At the workplace, the latch for the hook on a 2 ton HS Type Chain Block was missing. The hook was being used to support the right rear axle of a vehicle. Employees were exposed to a struck-by hazard. b.At the workplace, the latch for the hook on a 2 ton HS Type Chain Block was defective (sprung). The hook was being used to support the right front axle of a vehicle. Employees were exposed to a struck-by hazard. Among other methods, feasible and acceptable abatement methods to correct this include, but are not limited to the following: 1.Adhere to the guidelines listed on page 8, Section 16-1.29 Hooks of the ASME B30.16-2007 for Overhead Hoist (Underhung): Hooks shall be equipped with latches unless use of the latch creates a hazardous condition. When required, the latch shall be provided to bridge the throat opening of the hook and retain, under slack conditions, such items as, but not limited to, slings and chains.
