Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)On or about April 25, 2008 - South Quintard Avenue and K Street, Anniston, AL, a Caterpillar TH83 Forklift Truck, used to elevate personnel, was unattended. Among other methods, one feasible and acceptable method to correct this hazard would be to lower the load before leaving the forklift unattended as stated in ASME B56.6-1992 - Safety Standard for Rough Terrain Forklift Trucks, Section 6.2.12, Operating Safety Rules and Practices.
