Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall hazards while displaying merchandise in front of a
storefront:
On March 6, 2008, Abdallah Odeh dba Dollar Buster #22 had an employee
exposed to falling
a depth of 6 feet while working from the top step of a Husky 6ft
fiberglass stepladder.  The
manufacturer of the stepladder, Husky, had warning signs on the step
ladder
prohibiting
employees from working on the top most level of the stepladder.  Among
other methods, one
feasible and acceptable abatement method to correct this hazard is to:  a)
Follow and implement
the manufacturer's labeled requirements, "Do not stand, climb or sit on
braces, spreaders, pail
shelf, back section, or above second step from top of ladder." b)  Ensure
that employees do not
step or stand on the top cap and the top step of a step or trestle ladder
as prescribed in Section
9.3.2 of American National Standards Institute (ANSI) A14.5-2007, American
National Standard
for Ladders Portable Reinforced Plastic Safety Requirements.
