Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a) Town of Fremont employees are exposed to the hazard of being caught
under vehicles or the
lift structure, or being struck by a falling vehicle, in the event of a
hydraulic failure of the joyce
hydraulic lift (Model # 212BRSL) while servicing vehicles located in the
Town garage.
Note: Among other methods, one reasonable and adequate abatement method to
correct this
hazard is to equip the lift with a mechanical device to hold the lift in
all extended positions as
recommended by the American National Standards Institute and the
Automobile Lift Institute in
the Industry Consensus Standard ANSI/ALIB 153.1 "Safety Requirement for
the Construction,
Care and Use of Automobile Lifts". The device should have a strength
factor
of not less than
three (3), based on the rated load capacity of the lift.
