North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by or caught-in between hazards: a)facility, forklift trucks were installed with overhead guards, but seat belts were not worn by forklift operators, exposing them to struck-by hazards in the event of the forklift overturning. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require employees to wear seat belts when operating forklift trucks. Reference: American Society of Mechanical Engineers, Safety Standard for Low Lift and High Lift Trucks, ASME B56.1-1993, paragraph 5.3.19: "An active operator protection device or system, when provided, shall be used."

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards due to chainsaw use: a)veneer manufacturing, an employee was observed starting the STIHL chain saw, model 066 by drop starting and the chain brake was not engaged. Among other methods, one feasible and acceptable abatement method to correct these hazards is to ensure that employees follow the manufacturers instructions when starting and operating the equipment.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards due improperly selected rigging equipment: a)veneer manufacturing, the 5/16-inch grade 43 welded chain used in the job-made slings was not approved for use in overhead lifting applications. b)veneer manufacturing, the job-made pear shaped rings manufactured from rebar were not proof tested and approved for lifting applications. c)veneer manufacturing, the log grab hooks used in the job-made slings had handles welded to them and were used for overhead lifting. No proof testing was conducted following modifications to the hooks. Among other methods, one feasible and acceptable method to abate this hazard is to: 1.Purchase and utilize alloy steel grade chain slings for all overhead lifting operations. 2.If job-made slings are to be used, ensure the chain, rings, attachments and other components are approved for overhead lifting operations. Prior to placing job- made slings into service have the slings proof tested and maintain the certification in accordance with good engineering practices.

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a)sawmill, the rated capacity of the 6-inch I-beam spanning approximately 24-feet used as the supporting structure for the 1-ton CM Lodestar electric chain hoist had not been determined. Among other methods, one feasible and acceptable method to correct this hazard is to determine the capacity of the overhead structure and ensure that employees do not side load the structure. Reference: ANSI B30.16-1981, Overhead Hoists (Underhung), Section 16-1.3.2.
