Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the improper marking and use of below the hook lifting devices : a.) Production area Plant 2 - the "home-made" beam used to lift steel plates to the burning table was not marked with a rated load capacity, safety warning data, and its weight (i.e. the weight of the device itself). (Reference: ASME B30.20 Below the Hook Lifting Devices Section 20-1.2.1) Abatement Note: Among Other Methods, Feasible and Acceptable means to correct the conditions noted above include utilizing a durable substance or device to mark the beam with the following information: (1.) Rated load capacity (2) Spreader Bar Weight (3) Safety Warnings noted in ASME B30.20 Below the Hook Lifting Devices Section 20-1.2.1 (d)
