Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to being struck by approaching/passing vehicles:
(a)On or about December 22, 2009 and at times prior thereto, employees
positioned
themselves between two incoming lanes of traffic (i.e. stood in the
roadway) to Treasure
Lake in order to check for Property Owners Association (POA) stickers,
confront those
without stickers, and to hand out copies of the Security Policies. While
standing in the
roadway and attempting to stop traffic, employees were exposed to the
hazard of being struck
by approaching/passing vehicles.
ABATEMENT NOTE:
Among other methods,  feasible and acceptable means to correct the
conditions include:
1. Remove employees from the roadway
2. Utilize alternate methods such as:
a.) Retractable Gates to stop traffic, OR
b.) Contacting those that have not paid by phone, mail, or in person at
their
home
