Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to unguarded conveyor belt nip points: a) 2 East Bay Drive, Erie, PA - On or about February 11, 2010, as employees were replacing an 84" conveyor belt inside the forward hold of the Edgar B. Speer ship an employee was pulled into the moving conveyor belt as he walked across the belt guide. No guard or safeguard was provided to prevent access to this danger area.
