Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: Each employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees in that employees were to heavy equipment buckets (e.g. excavator, back-hoe, front-loader, etc.) utilized for the hoisting, raising, and lowering of personnel: a.) Construction Project/Meadville Area Water Authority --- North Street, Meadville, PA: Employees were riding in the bucket of a Kobelco 135SR to access and egress the trench. ABATEMENT NOTE: Among other methods, feasible and acceptable abatement means to correct the condition include: 1. Require personnel to utilize a ladder or ramp to enter/exit excavations. 2. Train personnel to ensure that they do not ride heavy equipment buckets. 3. Following the Equipment Manufacturers Institute (EMI) Safety Manual for Hydraulic Excavators which states that a bucket never be used as a work platform or personnel carrier. 4. Following the NIOSH Preventing Injuries When Working with Hydraulic Excavators and Backhoe loaders which states to not permit workers to ride in or work from excavator or backhoe loader buckets.
