Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a distorted, obstructed, and/or limited field of vision during operation of a wheel loader. a.) WLH Enterprises: The Caterpillar brand IT28G wheel loader had a cracked front and side windshield. This condition potentially exposed employees to heavy equipment type accidents including but not limited to struck by, crushing, caught between, and roll over. ABATEMENT NOTE: Among other methods, feasible and acceptable methods to correct this hazard include, but are not limited to: 1.) Replace the front and side windshields of the CAT IT28G 2.) Conduct daily inspections of the CAT IT28G in order to identify and then correct deficiencies. 3.) Follow other vehicle inspection and maintenance guidelines in accordance with the manufacturer's recommendations found in the owner's manual.
