Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to below the hook lifting devices (e.g., spreader bars) that
were not identified,
marked, labeled, load rated, and/or equipped with proper warnings:
a)Burn Building Overhead Crane -- Spreader Bar/Below-the-Hook Lifting
Device -- Marking and Labeling of Product Safety:  On or before January 27,
2011, the spreader bar was not marked with the product safety warnings
and/or
did not have a label, affixed to it in a readable position to bring the
label to the
attention of the operator.   The spreader bar was utilized in conjunction
with the
5-ton EMF Crane in the area of the burn table to lift sheets of steel and
occasionally "skeletons".  Employees working in the area were exposed to
struck-
by/caught between hazards and related crush injuries from falling loads
that were
suspended by the below-the-hook device.

Abatement Note:  Among other methods, feasible and acceptable means to
correct the
conditions noted above include utilizing a durable substance or device to
mark the
spreader bar with the information noted above found in ASME
B30.20-1.2.1(d)(1).
Such a label should include cautionary language to provide danger,
warning, or caution
notice to operators and others against:
(a)exceeding the rated load, or lifting loads not specified in the
instruction
manual;
(b)operating a damaged or malfunctioning unit, or a unit with missing
parts;
(c)lifting people;
(d)lifting suspended loads over people;
(e)leaving suspended loads unattended;
(f)removing or obscuring warning labels;
(g)operating without having read and understood the operating manual;
(h)not staying clear of the suspended load;
(i)lifting loads higher than necessary;
(j)making alterations or modifications to the lifter.
b)Burn Building Overhead Crane -- Spreader Bar/Below-the-Hook Lifting
Device -- Written Report of Load Test:  On or about January 27, 2011, a
written report was not furnished by a qualified person, confirming the
load rating
of the lifter (i.e. the spreader bar).  The spreader bar that is used in
conjunction
with the 5-ton EMF Crane in the area of the burn table to lift sheets of
steel and
occasionally "skeletons" was marked for a load rating of five (5) tons but
a
written report of load testing and confirmation of the spreader bar's load
capacity
was not completed by a qualified person.  Employees working in the area
were
exposed to struck-by/caught between hazards and related crush injuries from
falling loads that were suspended by the below-the-hook device.

Abatement Note:  Among other methods, feasible and acceptable means to
correct the
conditions noted above include subjecting the spreader bar to load testing
by a qualified
person who will furnish a written report to confirm the load rating of the
below-the-hook
lifting device as required by ASME B30.20-1.3.8.2(a).
