Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fiber glass ladders that were not utilized properly and/or
were not utilized in
accordance with manufactures instructions, requirements, and/or intended
use:
A.)Om Namah Shivay, Inc. dba Econolodge, 2810 South Hermitage Road,
Hermitage, PA  16148, 2nd floor balcony of the structure, northeast side,
on or
about August 5, 2011 and times prior thereto:  An employee was utilizing a
fiberglass Werner step ladder to access/egress the roof area. Employee was
stepping on/off the side of the ladder and over a railing to access/egress
the roof.
The fiberglass ladder was not secured from sideways motion produced from
stepping on/off the ladder. Condition exposed employee to a fall hazard in
that
ladders utilized in this manner could tip when the employee stepped onto
and/or
off of the step ladder.
ABATEMENT NOTE:  Amongst other means, acceptable and feasible methods
to correct the conditions include:
A.)Selection of the correct ladder to properly gain access to an upper
level
as prescribed by manufacturer's requirements and the requirements set
forth by the American Ladder Institute A14.5-2007.s
