Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential falls while riding/standing on the elevated and moving forks of a SKYTRAK all terrain forklift: a) On or about 3/25/08, at the Spencerport School District construction project at the contractor staging area. An employee was standing on the moving fork of an all terrain forklift, approximately 6 feet 8 inches above the ground, while the operator of the machine positioned the employee to place tarps over insulation. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS CONDITION IS: 1) Use a ladder, suitable to the conditions, for access on top of the insulation. 2) Use a personnel platform approved by the manufacturer of the forklift. NO ABATEMENT CERTIFICATION REQUIREDATION
