Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that, employees were exposed to the hazard of being
crushed by the roll over
of equipment:
(a)All Terrain Excavating & 2502 Liftline Way, Steamboat Springs, CO:
On or before June 6, 2008, the exposing employer did not ensure that the
employee operating a 325-Bobcat Compact Excavator, while conducting
devegetation and clearing activities on mountainous rough slopes, having an
the angle between 30-35 degrees, follow the manafucturer's recommendations
under the Operator's Safety Handbook. He traveled on side slopes exceeding
the maximum recommended side slope operating angle of 15 degrees. An
employee while operating the 325-Bobcat Compact Excavator slipped on a
rock and rolled down a steep embankment. The employee attempted to exit the
cab, when the machine rolled onto his lower body resulting in a fractured
pelvis, cuts and abrasions.
Among others, one feasible and acceptable abatement method to correct this
hazard
and to avoid injury or death is: Do not operate the 325-Bobcat Compact
Excavator on
slopes that are greater than the maximum recommended side slope operating
angle of
15 degrees, as recommended on the Operator's Safety Handbook. Employees
training
on recognization of machine safe operating slopes must be included on the
training
program.
Abatement Note: To avoid injury or death the Operator's Handbook states:
Do not travel
across or up slopes which are over 15 degrees to the side, or to the back
of the machine and
25 degrees to the front. Keep boom centered while traveling. Avoid steep
areas or banks that
could break away. For proper operator's instruction: Read machine signs,
Operation and
Maintenance Manual, Safety Manual, and the Operator's Handbook.
Abatement Note: Abatement certification and documentation are required for
this item (see
enclosed "Sample Abatement Certification Letter").
