Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that  were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of crushing injury when thrown from a
vehicle during
a rollover accident:
(a)Rocky Mountain Pavement Maintenance, Inc., West 73rd and Irving Street,
Westminster, Colorado:  On or about July 23, 2008 and at times prior
thereto, use
of seat belts when driving a compactor with rollover protection was not
enforced.
This exposes employees to the hazard of being crushed in the event of a
rollover
accident.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is:
1.Train employees regarding the hazards of compactor rollover and of the
importance of
wearing a seat belt when rollover protection is provided.
2.Enforce use of the seat belt on equipment with rollover protection.
Perform
unannounced inspections and require supervisors to document failure to use
seat belts
and follow up with disciplinary action.
