29 CFR 1910.178(c)(2)(iv): Power-operated industrial trucks designated as DY, EE, or EX were not used in locations where volatile flammable liquids or flammable gases are handled, processed or used, but in which the hazardous liquids, vapors or gases will normally be confined within containers or closed systems from which they can escape only in case of accidental rupture or breakdown of such containers or systems, or in case of abnormal operation of equipment: (a)Thyssen Krupp Safeway, Inc., 5801 Brighton Blvd., Commerce City, Colorado: On or about October 14, 2008, and at times prior thereto, industrial trucks operated in Class 1, Division 2, Group D areas such as the #4 HDS Unit were not classified for use in this type of location. There were no DY, EE, EX, or DX rated industrial trucks available for use at the refinery. This exposes employees to fire and explosion hazards. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").-Certification
