October 13, 2008, and at times prior thereto, industrial trucks operated
in Class 1,
Division 2, Group D areas such as the #1 Crude Unit and the #3 HDS Unit
were not
classified for use in this type of location.  There were no DY, EE, EX, or
DX rated
industrial trucks available for use at the refinery. This exposes
employees to fire and
explosion hazards.
