Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that an
employee was exposed to a fall of 30 feet while working from an unsafe
platform:
(a)True Built Custom Builders Inc. at 1365 Eagle Glen Dr., Steamboat
Springs, CO 80487:  The employer did not ensure the employees did not
work from an unsafe platform held aloft by a rough terrain forklift in
that the
employees worked at approximately 30 feet high in a job made platform
without restraining means.  This condition exposed the employees to fall
hazards of approximately 30 feet.
(b)True Built Custom Builders Inc. at 1365 Eagle Glen Dr., Steamboat
Springs, CO 80487:  The employer did not ensure the employees did not
work from an unsafe platform held aloft by a rough terrain forklift in
that the
employees worked at approximately 30 feet high in a job made platform that
measured at 192 inches and the outside of the tires on the rough terrain
forklift
was measured at 102 inches.  Therefore the platform was 70 inches too long
for this particular rough terrain forklift.  This condition exposed the
employees
to fall hazards of approximately 30 feet.
Abatement Note:  Among other methods, one feasible and acceptable
abatement method to
correct this hazard is:
Provide a restraining means such as a guardrail.  A Guardrail or similar
structure shall have a nominal height to the platform floor of 42 inches
and a
midrail at 21 inches with a toeboard of four inches nominal.  Such a
guardrail
system shall be capable of withstanding a concentrated horizontal force of
200
lbs without permanent deformation.
Employees working from a basket attached to a boom must also use
conventional fall protection.  Subpart M of this part (1926.502(d))
provides
that body belts are not acceptable as part of a personal fall arrest
system.
The
use of a body belt in a tethering system or in a restraint system is
acceptable
and is regulated under 1926.502(e).
Paragraph 8.25(b) of ASME B56.6-1992, The American Society of Mechanical
Engineers - An American National Standard - Safety Standard for Rough
Terrain Forklift Truck states "...nor have a width greater than the overall
width of the truck [measured across the load bearing tires plus 10 in. (250
mm) on either side.]
