Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard: (a)Hi-Performance Wash Systems Inc, at 279 West 64th Street, Loveland, CO: On 5/22/09, Hi-Performance Wash Systems Inc did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard. One employee performed maintenance activities at Wash Time Car Wash. The employee was struck by a motor vehicle. The work area was not secured, nor were car wash bays secured from use or vacated by motor vehicles. This condition exposed the employee to a struck-by hazard. Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard is to establish a work zone encompassing any car wash bays and driveway where work takes place. Car wash bays shall be coned off and all vehicles exited from bays before work may begin. Abatement Note: Training is to be provided to employees with regards to establishing a work zone and traffic safety. Abatement Note: Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter").-Certification
