Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard by the forklift in the event of a rollover: a)Asian Food Market:Employee not required to wear a seatbelt while operating a forklift. Violation observed on or about 9/20/08. ABATEMENT NOTE:AMONG OTHER MEANS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD WOULD BE FOR THE COMPANY TO INSTRUCT AND ENFORCE THE USE OF SEATBELTS.
