Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by a forklift in the event of a rollover: a) Employer failed to require employees to wear restraint devices when exposed to a tipping hazard. Violation observed on or about 3/16/09. AMONG OTHER MEANS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD WOULD BE FOR THE COMPANY TO REQUIRE EMPLOYEES TO UTILIZE THE SEATBELTS AND REINFORCE THIS REQUIREMENT TO THE EMPLOYEES DURING TRAINING.
