Section 5(a)(1) of the Occupational Safety and health Act of 1970. the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee in that employees were exposed to hazardous conditions when employee was exposed to fall hazards. a) 4 Farington Boulevard, Monroe, NJ 08831. Employee was elevated approximately 20 feet above the ground below while working from a metal framed basket which was not secured to the forks of the powered industrial truck and the employee was not donning any personal fall protection. Condition observed by CSHO on or about 08/08/09. ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS, THE WORK PLATFORM SHALL BE SECURED TO THE FORK CARRIAGE TO PREVENT FORWARD, LATERAL OR ROTATIONAL MOVEMENT. THE PLATFORM SHALL HAVE AN INTERMEDIATE RAIL AND A 4 INCH HIGH TOE BOARD ON ALL SIDES. THE WORK PLATFORM SHALL HAVE PERMANENT, LEGIBLE IDENTIFICATION PROVIDING INFORMATION OF PLATFORM WEIGHT, PLATFORM RATED LOAD, NAME AND ADDRESS OF THE MANUFACTURER OR ENGINEERING CERTIFICATION.
