Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from the dock and moving forklift equipment. a/ UPS Freight/Carteret NJ Site - Dock Plates/Bay Doors #14, #45, #51 and #56 1/ Dock plate at Bay Door #51 had a broken and/or missing spring. Spring was not provided and/or repaired to prevent employees from having to struggle (manually) to lift it. 2/ Dock plates at Bay Doors #14, #45 and #56 had missing bumpers. Dock bumpers were missing or damaged where they had fallen to the ground and not replaced. a/ Damaged bumpers were not replaced and/or bumpers that had fallen from their position had not been repaired and replaced. b/ Other bumpers that had deterioration, means had not been provided to determine when they must be replaced. Among other methods, one feasible and acceptable means of abatement would be to comply with the guidelines outlined in the American National Standard Institute (ANSI) For the Safety, Performance, and Testing of Dock Leveling Devices/Loading Dock Equipment Manufacturers - A Product Section of Material Handling Industry MH30.1-2000 (July 11, 2000) (Revision of ANSI MH-30.1-1993)
