Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to multiple injuries and death from a fall: Worksite: The employee who was cutting branches while sitting on a tree limb at approximately 35 feet above the ground did not positively attach his personal fall arrest system to a proper anchoring point. Among other methods, one feasible and acceptable abatement method to correct the hazard is to: 1. Provide employees with appropriate personal fall protection equipment (PFPE). 2. Ensure through visual observation and providing training and instructing that employees always properly wear and utilize the PFPE, including for properly anchoring the PFPE. 3. Follow the requirements of ANSI Z133.1-2006 paragraph 8.1.19 & 8.1.23. 4. Utilize other safe and effective means for "tree" cutting and trimming operation. 5. Utilize other engineering means of fall protection devices.
