North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to physical harm from collapsing storage racks due to damage caused by industrial trucks or forklifts: a)Warehouse/Office Area (7301 US Hwy 301 N): employees were observed to be exposed to crush and struck by hazards from a falling load, due to damaged storage racks. (Re: Interlake Storage Rack User Manual 2002 - "Identify and Address Any Column Damage", Rack Manufacturers Institute MH 16.1-2004 - 1.4.9 Rack Damage, ANSI MH 16.2-1984 - 1.3 Collision Protection, ANSI MH 16.2-1984 - 3.11 Damaged Rack, ANSI MH 16.2-1984 - 4.2 The Damaged, Dented, Buckled, or Bent Rack) Among other methods, one feasible and acceptable abatement method to correct this hazard is to replace damaged racks with new storage racks.
