North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall to lower level due to the removal of a guard rail (ref para 8.24.1 (l) ASME B56.6-2002): a)site-employees of a sub contractor were installing siding while standing in a locally made platform mounted on the forks of a GEHL model RSG-42 all terrain fork lift, without the platform being equipped with a front guard rail or other means of fall protection. One feasible means of abatement is to install front rail guards and provide personal fall protection to employees working in the platform.
