North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a)warehouse, storage - where employees were allowed to use aisle ways without sufficient lighting to access/egress work areas throughout the facility. b)warehouse, packing areas - where employees were required to pack and sort produce without sufficient lighting while being exposed to unguarded machines that contained conveyors, belts and gears. One feasible and acceptable abatement method, among others is to ensure that the illumination meets the requirements set forth by the ANSI standard.
