Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
Falls of up to 20 feet to the ground below from the basket of the forklift.
On or about July 31, 2008 at the job site: Employees were exposed to falls
of up to 20 feet to
the ground below from the work platform, attached to the SkyTrak B8400
forklift, which was
wider than the overall width of the truck plus 10 inches on either side.
Among other methods, one feasible and acceptable means to abate this
hazard is to use a work
platform that is designed in accordance with the American Society of
Mechanical Engineers
ANSI/ASME B56.6-2002, Safety Standard For Rough Terrain Forklift Trucks.
Pursuant to 29 CFR 1903.19, the employer must submit an abatement plan
describing the actions
it is taking to ensure compliance, including a description of how these
steps protect its
employees from falls from this work platform.
