Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Falls of up to 25' to the ground below from the basket of the forklift. On or about August 21, 2008, employees were potentially exposed to fall of up to 25' to the ground below from the work platform, attached to the New Holland M 428 forklift, which was wider than the overall width of the truck plus 10 inches on either side. Among other methods, one feasible and acceptable means to abate this hazard is to use a work platform that is designed in accordance with the American Society of Mechanical Engineers ANSI/ASME B56.6-6-2002, Safety Standards for Rough Terrain Forklift Trucks.
