Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
Being Struck By Vehicular Traffic.
The employer does not maintain a specific path of travel for vehicular
equipment, such as but
not limited to, Caterpillar TH 63 Forklift.  This violation was most
recently observed on or
about December 15, 2008 at the job site where the employees were walking
in the same path
as the equipment, exposing the employees to struck by hazards.
Among other methods, two feasible and acceptable means to abate this
hazard are to safeguard
pedestrians in accordance with ASME B56.6, 2002, Safety Standard for Rough
Terrain Forklift
Trucks, and to perform job hazard analyses for tasks performed in the
areas
where vehicle traffic
is also permitted.  Such analysis would include assessments of the tasks
performed, including
their purpose and timing, the vehicles needed along with their purpose and
timing, and the
environment, such as configuration, suitability of physical barriers and
the wearing of reflective
vests.
