Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
Being Struck-by or Crushed by.
On or about March 20, 2009, the employer did not ensure that the crane
operator was and has
been fully trained in the operations, handling and meets the
qualifications of operating the P &
H, RT 25T truck crane.  The employees were exposed to crushing and/or
struck by hazards due
to operator not being qualified or trained in operating the crane.
Among other methods, one feasible and acceptable means to abate this
hazard is to train the
crane operators in all operations of handling the crane and to ensure they
meet the qualifications
set forth in ASME B30.5, 1994, Section 5-3.1 Operator Qualifications and
Operating Practices.
