Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees
in that employees
were exposed to crushing hazards:
On or about June 19, 2009, the employer did not insure the employee
operating the Komatsu
WB 140 backhoe was utilizing the seat belt.  The employee who operated the
backhoe without
using the provided seat belt was exposed to a crushing hazard.
Abatement Note:  Among other methods, one feasible and acceptable
abatement method to
correct this hazard would be to enforce the use of seat belts by employees
when operating
equipment.
