Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
Being caught-in between the truck and the trailer.
On or about September 11, 2009, in the yard area, the employee was exposed
to caught-in
between hazards of being pinned between the fifth wheel assembly of the
Peterbilt truck and the
trailer when assisting in raising the stabilizing bar on the trailer.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT MEANS
TO CORRECT THIS HAZARD IS:  1)  Develop and implement written procedures
requiring
that employees are not allowed in the yard while moving trailers or the
rescheduling of trailers
to different docks.  2)  Develop and implement a means of communication to
be used by the
drivers and the yard personnel.  The task may be accomplished through hand
signals or by some
form of radio communication. 3)  Develop and implement a disciplinary
action plan to ensure
that the procedures are being followed.  4)  Provide and enforce the use
of high-visibility
reflective safety vests to ensure that the employees would be visible to
vehicular traffic.
Abatement, certification and documentation is required for this violation.
The documentation
should include written verification of abatement, and a signed roster
indicating that the
employees have been trained regarding the trailer and truck movement
policy.
