Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees
in that employees
were exposed to crushing hazards:
On or about November 13, 2009, the employer did not ensure that the
employee operating the
Genie GTH-636 All Terrain Telehandler was wearing the attached provided
seatbelt exposing
the employee to a crushing hazard.
Abatement Note:  Among other methods, one feasible and acceptable means of
abatement to
correct this hazard would be to enforce the use of seatbelts for employees
when operating this
equipment.
