Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a)On or about October 17,2008, at 12100 Westheimer Road, Houston, Texas, an employee was exposed to fall and ejection hazards while riding in and standing in the elevated bucket of a Case Model 580M backhoeom the bucket of a backhoe while riding this bucket and standing inside of the bucket of a backhoe. Methods to correct hazard include prohibiting the use of a backhoe bucket as a personnel platform, prohibiting riding on the machine unless an additional seat with all of the proper safety equipment has been installed, follow all manufacturer's recommendations in the Safety Section of the Owner's manual and the safety regulations outlined in the Safety Manual For Operating and Maintenance Personnel for Wheel Loader/Tractor, from the Association of Equipment Manufacturers, accompanying the rental equipment.
