Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of struck by: (a)The employer did not ensure that repairs or replacements to the boom were provided promptly as needed for safe operations of the American Crawler Crane, Serial # GS4170, Model # 595-C. This violation was most recently observed on November 5, 2008 at Seaquest Recovery, LLC. ABATEMENT NOTE: Among other procedures, on feasible and acceptable abatement method to correct the hazard is for the employer to comply with ASME B30.5-2004, Mobile and Locomotive Cranes, Section 5-2.3.3, paragraph (c), Maintenance, Adjustments and Repairs.nts
