Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by the lifting magnet on the crane and/or a dropped load: (a)Steel yard: On or about November 13, 2008, the employer did not ensure that the lifting magnet in use on the 25 ton yard crane was labeled with its rated capacity, exposing employees to a struck by hazards from falling billets weighing up to 19,900 pounds. ABATEMENT NOTE: Among other methods one feasible method to correct this hazard is to follow the requirements of ANSI B30.20-1993 for Below the Hook Lifting Devices, Chapter 20.3 that states in section 20.3.2-Marking, Construction and Installation the following: Paragraph a-1-General application magnets shall include the rated load (capacity) of the magnet marked on the magnet or on a tag attached to it. This capacity rating shall refer to the instruction manual for information relating to decreases in rating due to the load surface condition , thickness, percentage of contact with the magnet, temperature, metallurgical composition and deflection.Paragraph d-1: Caution; All lifting magnets shall have affixed labels which include, but are not limited to, the word "CAUTION" or other legend designed to bring the label to the attention of the operator. Paragraph d-5: Manually controlled permanent magnet labels shall contain additional precautionary language about operating with the control handle latch not fully in the "Lift" position."DISCLAIMER: 1) You are not limited to the abatement methods suggested above. 2) The methods explained are general and may not be effective in all cases. 3) The employer is responsible for selecting and carrying out an appropriate method.
