Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazards of being struck-by
vehicular traffic:
a/  At the job site, employee(s) were exposed to the hazard of being
struck by vehicular traffic due to the
employer's failure to place traffic control signs or barricades along the
north and south bound lanes of Elm
Street and the east and west bound lanes of Maple Street.  Employee(s)
were excavating a trench along the west
side of Elm Street and operating a Deere 410E Turbo 4 x 4 Backhoe and
Caterpillar Skid Steer effectively
blocking the intersection.
One method of abatement to correct this apparent hazard is to post
suitable barricades and traffic control signs
as required by Part VI, Section 6C.04, of the Manual Uniform Traffic
Control Devices, Millennium Edition,
December 2000.
