North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to fall and struck-by hazards:
a)jobsite, 8118 Statesville Road, Charlotte, employer
operated a forklift designed to lift material, (labeled:
DANGER! DO NOT USE THIS MACHINE AS A PERSON LIFT, OR FIT
MACHINE WITH ANY FORM OF PERSONNEL WORK PLATFORM. FAILURE
TO HEED WILL RESULT IN DEATH OR SERIOUS INJURY), as a
personnel lift from which he allowed, directed and/or
supervised employees to work, from two separate
attachments, at elevations of 6 - 12 feet, and underneath
with attachment positioned 2 - 4 feet above working
employee.
Among other methods, one feasible and acceptable method
to correct these hazards is to prohibit employees from
using forklift attachments as work platforms and prohibit
employees from working under loads.
